This website provides a platform that enables us to verify and authenticate the identity of the authorized user(s) of the Applicants or customer for the opening of business accounts and/or accessing our products and/or services (the “Site”). The Site is supported by third party service provider(s). Once you, being the authorized user, has logged on to the Site, you will be asked to provide your data and information (including your biometric data) and documentation necessary to verify and authenticate your identity. In particular, the Site enables you to provide images and/or videos of yourself to us for verifying and authenticating your identity to support the provision of financial services and products to the Applicant or customer, for and on behalf of which you are authorized to represent.

The Site also includes the secure pages of this website which require an access code in order to access them. The Site is operated by HSBC Bank plc ('we', 'us' and 'our'). HSBC Bank plc is incorporated in England and Wales and established at 8 Canada Square, London E14 5HQ which is its registered office. To the extent that there is any conflict between any of the terms and conditions, the following shall be the order of precedence in relation to such conflict:

2. Site Terms and Conditions.

Note that particular products and services provided by any member of the HSBC Group will have their own terms and conditions which will form the legal agreement between the Applicant or customer and that member of the HSBC Group. You, and the Applicant or customer, should carefully read such terms and conditions before obtaining the product or service from that member of the HSBC Group.

Site Terms and Conditions

We may amend the Site Terms and Conditions at any time without notice. Your use of the Site after such amendment will be subject to the Site Terms and Conditions as amended.

Privacy Notice

We collect and process your data and information in accordance with the privacy notice of the HSBC Bank located in the country/region in which your business account is to be opened. We may store your data and information locally or overseas, including in data centres operated by us, the HSBC Group, third parties or cloud providers. Please note that the Site will only retain data and information for a period specified in a privacy notice or otherwise as long as there is a business reason to do so. Information contained in any uncompleted forms will be deleted regularly from the Site.

It is your responsibility to ensure that only you are permitted to access and/or share information contained on this Site.

By uploading your identity documents and an image or video of yourself to the Site, you understand that your information will be shared with the service provider(s) which is (are) not associated with the HSBC Group and may be operating outside the country/region you reside supporting this Site and you agree for us or the relevant HSBC Group member to use such data and information to verify and authenticate your identity.

Availability of the Site, products and services

The content, including layout, of this Site or products or services available via this Site may be wholly or partially suspended, withdrawn or changed at any time. We reserve the right at any time to immediately suspend the provision of all or any part of this Site to you and/or block your access to this Site.

Submitting information to the Site

You are responsible for ensuring that any content (including images or videos) you upload to the Site is free from viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful. We may reject and delete any content which we, in our sole view, consider may be malicious or technologically harmful.

You confirm all data and information you provide or upload to the Site are accurate and complete. In particular, you confirm you are using your genuine identity when you act on our request to upload an image or video of yourself to the Site for identity verification and authentication.

You must ensure that you have all appropriate permissions prior to uploading any information to this Site. We or a HSBC Group member will not be responsible, or liable to any third party, for the content or accuracy of any information posted by you or any other user of this Site.

We or a member of HSBC Group also have the right to disclose your identity to any third party claiming that any content posted or uploaded by you to this Site is inaccurate or constitutes a violation of their intellectual property rights, or of their right to privacy.

You are solely responsible for securing and backing up your content.

Any data or information uploaded to this Site will be subject to these Site Terms and Conditions and your personal data and information will be handled in accordance with our Privacy Notice. Whenever you upload content to the Site, you, the Applicant and/or the customer grant us a limited licence to use, store and copy that content as described in the Site Terms and Conditions and any other relevant agreement between you, the Applicant and/or the customer and a member of the HSBC Group.

No warranties

Other than the warranties and representations contained in the Site Terms and Conditions, all other warranties and representations, whether express, implied or statutory are, to the fullest extent permitted by the law, excluded. The use of the Site is at your sole risk.

While we have taken reasonable steps to ensure the accuracy, currency, availability, correctness and completeness of the information contained on the Site, information is provided on an "as is" and "as available" basis.

Neither we nor any other member of the HSBC Group represent or warrant that the Site will be available and meet your requirements, that access will be uninterrupted, that there will be no delays, failures, errors or omissions or loss of transmitted information, that no viruses or other contaminating or destructive properties will be transmitted or that no damage will occur to your computer system. You have sole responsibility for adequate protection and back up of data and/or equipment and for undertaking reasonable and appropriate precautions to scan for computer viruses or other destructive properties.

Miscellaneous

Any notice to be given under these Site Terms and Conditions must be communicated by post, email or facsimile to the address most recently notified by the receiving party. Receipt of notice shall be deemed to occur at the time when the notice would in the ordinary course be delivered or transmitted. If any part of these Site Terms and Conditions is found by any court or other competent authority to be invalid, unlawful or unenforceable then such part shall be severed from the rest of such terms which shall continue to be valid and enforceable to the fullest extent permitted by law.

Exclusion of our liability

E-Signatures

In order to subscribe for products or services electronically and to receive documents that are required to be “in writing” in electronic form, you will need to agree to the use of electronic signatures and records in your dealings with us. Your agreement applies to any transaction that you complete with us or any document that we may communicate between us. Electronic communications may be delivered to you by making them available via the relevant service, or by sending you an external email at the email address you have provided to us. All such electronic communications will be effective when a notification is made available or sent to you, and you hereby waive all claims resulting from failure to receive communications because of your failure to access the relevant service or changes in your contact details.

By agreeing to these Site Terms and Conditions, you, the Applicant and/or the customer and/or authorised user of the Site, consent to the use of electronic records and signatures in all of your dealings with us. You are also confirming that you are authorized to, and do, consent to the use of such electronic records and signatures on behalf of the entity or party and/or group of companies you represent.

Governing law

These Site Terms and Conditions are governed by and are to be interpreted in accordance with the laws of England and Wales. The courts in England and Wales will have non-exclusive jurisdiction in respect of any dispute which may arise in connection with these Site Terms and Conditions or your use of this Site.
